Fire Code Enforcement

The Niagara Falls Fire Department is the authority for fire safety matters in our city and has adopted a zero-tolerance approach to violations of the Ontario Fire Code.


Fire Code

We enforce the Ontario Fire Code, which is a regulation under the Fire Protection and Prevention Act, 1997 (FPPA). The Code sets requirements for fire safety for equipment, systems, buildings, structures, land and premises, including the risk created by the presence of unsafe levels of carbon monoxide. The building owner is responsible for complying with the Code, except where otherwise specified.

Fines and penalties

Property owners who fail to ensure their properties meet fire and life safety standards will be charged under the Provincial Offences Act. They are subject to penalties under the Fire Protection and Prevention Act.

  • Individual: Fine up to $50,000 for a first offence and not more than $100,000 for a subsequent offence, or imprisonment for up to one year. Or both.
  • Corporation: Fine up to $500,000 for a first offence and not more than $1,500,000 for a subsequent offence.

Fire investigations

After a fire, investigations are primarily conducted by Fire Prevention Officers. In some situations, the police and staff from the Office of the Fire Marshal and Emergency Management may be involved. Information obtained through these investigations assists us in determining specific trends relating to fires within the city and allows our staff to focus their prevention activities to reduce the risk of these occurrences.
