Notice of Committee of Adjustment Public Meeting (A-2021-044)
The subject property known as 4129 Acheson Avenue located on the west side of Acheson Street between Leader Lane and Ferguson Street.
The applicant is requesting the Committee of Adjustment to consider an extension/enlargement of a legal non-conforming use, through a process permitted by Section 45(a)(i) of the Planning Act (R.S.O. 1990, c.P.13).
The applicant is proposing to renovate the third storey of the existing legal non-conforming six-plex dwelling located on the subject property. The existing dwelling was constructed in 1950 and predates the current by-law. Section (45)(a)(i) allows for the enlargement or extension of a building or structure, if the building or structure on the day the by-law was passed was lawfully used for a purpose prohibited by the by-law. The applicant is requesting approval to permit the extension/enlargement of a legal non-conforming use.
