Road Occupancy Permits
A Road Occupancy Permit (ROP) is required if you use City property, such as a road, sidewalk, or boulevard, to do work or other activities. Without this permit, you cannot block or occupy any part of the City’s right-of-way.
When you need a road occupancy permit
Here are some examples of activities that require a permit. This is not a complete list.
- Construction on a road, boulevard or sidewalk
- Occupying a lane on a City road
- Temporary or partial road closures
- Window washing or building maintenance from a public sidewalk
- Working on private property that requires access from a road, sidewalk, park or trail.
- Utility repairs or installations
- Placing moving containers, dumpsters, or storage units on the road or boulevard
- Storing building or landscaping materials on a road or boulevard
- Sidewalk obstructions that affect pedestrians
When you need a permit from another authority
A Road Occupancy permit from the City is only valid for roads managed by the City of Niagara Falls.
If your work affects roads managed by others, like the Niagara Parks Commission or Niagara Region, you’ll need to get permits from them. You can check road using the Niagara Falls Street Name Index.
Apply for a road occupancy permit
Submit your application, required documents, and payment at least five business days before the work begins. If approved, you will receive a permit number and details about any required security deposit.

Required documents
To complete your application, you must upload the following:
- Insurance certificate: Requires $5 million liability and $2 million auto, and the Corporation of the City of Niagara Falls must be named as additional insured. Use the Standard Liability form on the City’s Certificate of Insurance form page.
- Traffic control plan: Prepare and follow a Traffic/Pedestrian Protection and Control Plan that meets the Occupational Health and Safety Act and the Ontario Traffic Manual (OTM) Book 7
- WSIB: Submit a valid WSIB clearance certificate for the entire duration of the work
Fees
- The Permit Coordinator determines the fee at the time of application using the current Schedule of Fees. The administration fee ranges or could be up to a percentage of the construction value, depending on the project.
- The Permit Coordinator determines the security deposit amount at the time of application
- Before starting work, pay the fee and any required security deposit in person with cash, cheque, or debit
Returning your security deposit
All restoration work must be completed within six months of the date the road occupancy permit is issued.
Once your work is finished and approved by the City, you will need to register for electronic funds transfer payments. Complete the online Electronic Funds Transfer (EFT) Application Form.
