Deeming By-law

A deeming by-law is a rule that removes land from a registered subdivision plan if the plan has been in place for more than eight years. It combines two or more lots into one piece of land. This is often needed for development when lot lines would otherwise stop buildings from being built across them.


When is a deeming by-law needed?

You need a Deeming By-law to:

  • Combine two or more lots or blocks in a registered subdivision under the same owner
  • Build a structure on a single piece of land after combining lots

How to apply for a deeming by-law

Step 2: Submit Your Application

You will need to include:

  • A letter to the City requesting a deeming by-law
  • The property deed and PIN
  • Registered Plan of Subdivision (59R Plan)
  • All required application fees to the City - check the Schedule of Fees
